General Terms and Conditions

$ 1 General (1) The use of the park and the facilities and objects contained therein by the participants is subject exclusively to these conditions. Conflicting conditions of the participants will not be accepted. (2) Additional, separate terms of use may exist for individual facilities in the park. The content and validity of these terms and conditions will be notified to the visitors individually by the security/supervising personnel at the respective facilities. Notices of the organizer are to be observed. (3) Leaving marked paths and areas is not permitted. Existing barriers within the park must always be observed by the participant. Accompanying persons are not permitted to enter the park during operation. § 2 Scope of services owed (1) Participants are entitled to use the entire park against payment of the entrance fee. (2) The organizer is entitled to cancel, restrict or interrupt the participation of visitors in the park for reasons of safety for the participants and weather conditions. In this case, the rights of the participant remain unaffected. § 3 Requirements for Park Use / Participant’s Behavior (1) Participation in the park under the influence of narcotics and / or alcohol is prohibited. All visitors and their concerns are to be taken into consideration throughout the park. (2) Smoking is prohibited in the entire park. Please dispose of waste at a suitable place. (3) Dogs must be kept on a leash throughout the park. (4) Participation in the park is suitable for visitors over 6 years of age and 1 metre tall. Participation in the park requires sufficient physical fitness of the participant. Visitors who do not fulfil this requirement and / or suffer from an illness, mental or physical impairment are excluded from participating in the park. If one of the aforementioned reasons for exclusion of a participant is only established by the supervisory/security personnel, the participant will be excluded from using the park with reimbursement of the entrance fee. (5) With regard to the safety equipment provided by the organizer, the organizer is entitled to exclude persons from participation in the park who exceed a maximum weight. The maximum permitted weight is 130 kg. (6) Each participant must participate in the obligatory safety briefing by the Organiser before using the Park. The instructions given there by the personnel must always be followed. Repeated violations of instructions given can, if they constitute a culpable breach of duty on the part of the participant, lead to the exclusion of the use of the park after prior warning. (7) For safety reasons, no objects such as openly worn jewellery, mobile phones, cameras, etc. may be carried along when using the park or facilities. Long hair must be tied together with a hair tie. It is absolutely necessary to wear closed, sturdy shoes. Flip flops are prohibited. (8) Pregnant women are not allowed to participate in the park. (9) Minors are permitted to use the park with written permission or in the presence of a supervising adult. The consent must be presented before the use of the park begins. The corresponding form is available at the ticket office. (10) Children between the ages of 6 and 9 may only use the park if accompanied by a supervising adult. § 4 Liability of the Organiser The organizer, his legal representatives or vicarious agents are only liable in case of intent or gross negligence. In the event of a breach of essential obligations, the liability of the organiser shall also apply in the event of simple negligence, but shall be limited to the foreseeable damage typical of the contract. This shall not affect damage resulting from injury to life, limb or health or from mandatory statutory liability regulations. § 5 Contribution of valuables (1) Participants are strongly advised not to bring valuables into the park. The organizer does not owe any guarding / custody for objects brought in nevertheless. (2) The deposit of money or valuables in a cupboard provided by the Organiser does not constitute any further obligation on the part of the Organiser to monitor/keep the objects brought in. In this respect, the Organiser shall not guard any cupboards made available by the Organiser. § 6 Equipment (1) The organizer provides the participants with safety equipment for the purpose of using the park and the facilities/stations available therein. The borrowed safety equipment may not be removed or transferred to other persons during the use of the rope park, unless the safety / supervisory personnel have given their permission. The equipment received must be returned to the organizer before leaving the park according to the individual instruction of the participant. (2) Participants are not permitted to bring and use their own safety equipment. (3) The participant treats the safety equipment borrowed from the organizer with the necessary care. The safety equipment shall only be used for its intended purpose and on the instructions of the safety / supervisory personnel. (4) Smoking and going to the toilet while using the safety equipment are prohibited. § 7 Personal data The organizer does not pass on personal data of the participant to third parties. Otherwise, data will only be passed on to third parties if the participant expressly consents to the data being passed on in advance or if there is a legal obligation to pass on data. If the participant has given consent, the participant can revoke this at any time with effect for the future by simply notifying the organizer (e.g. by e-mail, letter). There will be no order data processing. The organizer will not store any collected data for longer than is necessary for the purpose of processing the contract. If the participant wishes to obtain information about the data stored by the organizer or to have them deleted, a simple request (e-mail, letter) to the organizer is sufficient.
